ERT Grievance No.12 of 2019.
VILIKESA MOCEVAKACA was terminated on allegations of gross misconduct on 26 September 2018. The Union filed a dispute on the unlawful, unfair and unjustified dismissal within 21 days of termination. With the first hearings commencing on 12th March 2021 and the second on 18 February 2022. The ruling was handed down on 1st July 2022. The Employment Relations Tribunal made the following orders:
- That the termination of the worker VILIKESA MOCEVAKACA was unlawful, unfair and unjustified.
- The worker is to be reinstated to his former position without any loss of benefit, pay or seniority.
- No order as to costs.
This is a win for the member of our union and we fully expect the employer to comply with the ruling without undue delay.
